Attorneys may retain Dr. Bernard for either a discrete consultation or continuing litigation support through deposition, evidentiary hearing, or trial.

Much of this work never becomes a report. Reviewing an opposing expert's opinions, identifying methodological weaknesses, and preparing questions for examination are consulting functions rather than testimony.
